Governor Ducey Signs HBACA Water Fee Bill

On May 10, 2016, Arizona Governor Doug Ducey signed House Bill 2391 related to municipal water fees. The bill, which was sponsored by the HBACA, prohibits a city or town from funding the purchase of a water or wastewater company through a fee assessed on new homes. The HBACA believes this is an important protection for three reasons.

 

  • All users benefitted by the acquisition will share the cost equally by building the cost of acquisition into the rate base. 
  • It will increase transparency for consumers and landowners when municipalities raise water rates, fees, and other charges. 
  • The adoption of a fee to purchase a water or wastewater company will hinder the economic development opportunities inside the service area of the water or wastewater company.
